Information sought:
1. Copy of Minutes of Selection Committee for the post of Asstt. Teacher (General).
2. Copy of Broad Sheet in which the Selection Committee has awarded the marks to the
candidates.
3. Copy of Complainant along with the document he attached, i.e Qualification and Experience Certificate.
4. Copy of Experience Certificate found forged along with the copy of investigation/ verification received by the School from the previous School/Deptt.
5. Copy of service agreement executed by Complainant from the Manager of the time Appointment.
6. Copy of Complainant Joining Report.
7. Copy of Rule 4 of Indian Air Force Education Code.
Reply of PIO:
PIO stated that information sought by Complainant was not pertaining to that office. RTI Application had been forwarded to Management and requested to approach CPIO (Air Force
Station, Palam) for the said information.

Grounds for Complaint:
Complainant stated that information had not been provided whatever in support of termination
was. He alleged that RTI application was not transferred within 5 days.
He requested to order to Management of the school, Palam Delhi Cantt and CPIO to provide the
information/documents and to impose penalty for delaying.
Relevant Facts emerging during Hearing:
The following were present:

Respondent: Mrs. Anju Popli on behalf of PIO Mr. A.K.Tyagi The PIO states that the application was transferred on 05/05/2009 to Mrs. Reena Behal (Sqdn. Leader), PIO & Manager, Maude Line Air Force Primary School, Palam, Delhi Cantt – 110010.
Mrs. Reena Behal did not provide any information and the Respondent has brought the information with her and given it to the Commission. She states that she is not aware whether it is sent to the Complainant.
Decision:
The Complaint is allowed.
The Commission will send the information to the Complainant.
The issue before the Commission is of not supplying the complete, required information by
the PIO within 30 days as required by the law.
From the facts before the Commission it is apparent that the two PIOs Mrs. Reena Behal and Mr. A.K.Tyagi are guilty of not furnishing information within the time specified under subsection (1) of Section 7 by not replying within 30 days, as per the requirement of the RTI Act. It appears that the two PIO’s actions attract the penal provisions of Section 20 (1).
A showcause notice is being issued to them, and they are directed to give their reasons to the Commission to show cause why penalty should not be levied on them.
They will come and give the dates on which the change of PIO occurred.
They will present themselves before the Commission at the above address on 09 September 2009
at 10.30 am alongwith their written submissions showing cause why penalty should not be
imposed on them as mandated under Section 20 (1).
This decision is announced in open chamber.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.

ReplyDeleteदोपहर के लगभग 12.30 बजे हैं। पिछले पांच साल में जिस कालीदास मार्ग के पांच नंबर बंगले के सामने परिंदा भी नहीं दिख सकता था, वहां दिख रहे हैं अनगिनत सिर। गाड़ियां खड़ी हुई। सुरक्षा कर्मी मुस्तैद पर, मूकदर्शक। कहीं कोई रोक नहीं और न टोकाटाकी।
ReplyDeleteमुख्यमंत्री से मिलने जाने वालों के लिए बने दरवाजे पर सुरक्षा कर्मी तैनात लोगों से हंसकर बात करते हुए। अंदर जाकर मुख्यमंत्री अखिलेश यादव से मिलकर उनके सामने अपनी समस्या रखने की जिद करने वालों को यह समझाते हुए, ‘आज विधायकों, सांसदों और पूर्व विधायकों और सांसदों से ही मुख्यमंत्री को मिलना है।’ इसी बीच आवाज सुनाई देती है, ‘अरे! वाटर कूलर तो काम ही नहीं कर रहा है। थोड़ा-थोड़ा पानी आ रहा है। पानी कहां मिलेगा।’
बगल में खड़ा सुरक्षा कर्मी हंसते हुए कहता है, ‘पांच साल तो बेचारा चला नहीं। इसलिए मशीनरी जाम हो गई। अब चलना शुरू हुआ है तो धीरे-धीरे ही चलेगा।’ भीड़ से कोई बोलता है, ‘भगवान करे आगे से प्रदेश की मशीनरी जाम न हो।’ इसी बीच, हरा-कुर्ता पहने एक सज्जन गाड़ी से उतरकर प्रवेश द्वार पर पहुंच जाते हैं। सुरक्षा कर्मी सैल्यूट करते हैं और उनसे मोबाइल फोन बाहर किसी को देने का आग्रह करते हुए उन्हें प्रवेश दे देते हैं। किसी की आवाज आती है, ‘अरे! यह तो सुल्तानबेग गए हैं। बसपा से विधायक हैं।’
दरवाजे पर खड़ा सुरक्षाकर्मी कहता है, ‘पार्टी से क्या होता है। किसी भी पार्टी का मौजूदा और पूर्व जनप्रतिनिधि मुख्यमंत्री से मिल सकता है। मुख्यमंत्री किसी पार्टी का थोड़े होता है।’ एक विधायक अंदर दो लोगों के साथ जाने लगते हैं तो सुरक्षाकर्मी उनसे अकेले जाने आग्रह करते हैं। विधायक कहते हैं, ‘अरे! यह हमारे जिला अध्यक्ष हैं। जिला अध्यक्ष के बगैर विधायक का क्या मतलब। फिर वह जिलाध्यक्ष का हाथ पकड़े अंदर चले जाते हैं।’
घड़ी की सुई 1 पर पहुंच चुकी है और उसी के साथ बढ़ चुकी है फरियादियों की भीड़। किसी को जमीन को कब्जे से मुक्त कराना है तो बीएड बेराजगार भी नौकरी की चाहत में मुख्यमंत्री से मुलाकात कर लेना चाहते हैं। बात शायद अंदर तक पहुंचती है। थोड़ी देर बाद एक सुरक्षाकर्मी फरियादियों से प्रार्थनापत्र लेने लगता है। भीड़ को बताया जाता है, ‘मुख्यमंत्री जी ने सभी प्रार्थना पत्रों को मंगाया है।’ पर, कुछ लोग मुख्यमंत्री के हाथ में ही प्रार्थनापत्र देना चाहते हैं।
इस बीच, एक-एक करके कई विधायक और सांसद मुख्यमंत्री आवास के अंदर जा चुके हैं। मुख्यमंत्री आवास के बाहर जमा मीडिया को अब यह जिज्ञासा है कि कोई विधायक या सांसद बाहर निकले तो कम से कम अंदर के माहौल का अंदाज लग सके। इस बीच, एक भगवा वेशधारी भी मुख्यमत्री आवास पर पहुंचकर मुख्यमंत्री से मिलने की जिद करने लगता है। भीड़ का दबाव बढ़ता है तो बाहर आते हैं मुख्यमंत्री के सुरक्षा अधिकारी शिवकुमार।
बीएड बेरोजगारों से कहते हैं, ‘मैं भी 1977 का बीएड हूं। आपसे हमदर्दी है। पर, एक-एक व्यक्ति के लिए सरकार नीतिगत फैसला नहीं कर सकती। सरकार विचार कर रही है। आप लोगों की समस्याओं पर भी और बीटीसी, विशिष्टि बीटीसी या शिक्षक पद की अन्य योग्यता रखने वालों की समस्याओं पर भी। सब पर फैसला होगा। कम से कम कुछ समय तो दें सरकार को।’
कानपुर से आई एक महिला नेता सुरक्षाकर्मियों से अंदर भेजने की जिद करती हैं। कहती हैं, ‘अनीता जी से बात करके आई हूं।’ सुरक्षाकर्मी मुस्कराते हुए कहता है, ‘अनीता मैडम से मिलकर आई हैं तो अपायन्मेंट तय करा लेती। वह थोड़ा सा बोल देंगी तो आपको इस तरह यहां खड़े ही नहीं होना पड़ेगा।’ इसी बीच, अंदर से सांसदों और विधायकों के बाहर निकलने का सिलसिला शुरू हो जाता है।
अंदर हुई बातचीत पर मुस्कराते हुए जवाब, ‘बिजली-पानी, सड़क-स्कूल। बातें तो सब हुई हैं लेकिन यही क्या कम है कि पांच साल बाद हम लोगों की मुख्यमंत्री से मुलाकात तो हुई। मुख्यमंत्री जी! जो जैसे चाह रहा वैसे मिल रहा है। जिलावार भी, व्यक्तिगत भी और समूह में भी।’ शाम के लगभग 4 बजे रहे हैं। बाहर दरवाजे पर जमा भीड़ लगातार मुख्यमंत्री से मिलने की जिद कर रही है। थोड़ी देर में उनमें से भी एक-एक करके अंदर भेजना शुरू हो जाता है।
