Heard Sri Ashok Khare, learned Senior Counsel assisted by Sri Sushil Kumar Mishra, for the petitioner, Sri Tej Bahadur Rai, learned counsel holding brief of Sri C.K. Rai, for the respondents no.3 & 4 and Sri Mata Prasad, learned Additional Chief Standing Counsel for the respondents no.1 & 2.
The petitioner is seeking a direction to the respondents to grant her appointment on the post of Assistant Teacher (Science) in a Senior Basic School, District Jhansi in pursuance of the counselling held on 21.07.2014.
According to the petitioner she participated in the counselling under the Freedom Fighter Quota but she was not given appointment on the ground that the certificate of Freedom Fighter mentioned her father's name as Ajay Kumar Tiwari whereas her grand father's name shown as Thakur Das Sharma.
No useful purpose would be served by keeping this writ petition pending.
The writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with a direction to the respondent no.4, Basic Shiksha Adhikari, Jhansi to reconsider the claim of the petitioner for appointment as Assistant Teacher (Science) after verifying her quality point marks� as to whether she had secured more quality points marks than the last candidate as per the merit list. The respondent no.4 shall also consider the claim of the petitioner on the basis of the fresh certificate of Freedom Fighter dated 15.10.2014,� Annexure-9 to� the writ petition verifying the position with regard to the petitioner's father being named as Ajay Kumar Tiwari and her grand father being named as Thakur Das Sharma.
This exercise shall be completed by the respondent no.4 within one month from the date a certified copy of this order is received in his office.
