Pursuant to order dated 13.11.2012 Sri Sanjay Sinha, Secretary, U.P. Basic Education Board is present. An application and affidavit has been filed by Sri B.P.Singh, learned counsel representing respondent nos.1 and 3. In paragraph 4 of the affidavit it has been stated that on account of illness of Sri Nitishwar Kumar, Secretary, Basic Education, Government U.P he is not present today. However, he would remain present as and when the Court requires. By means of this application, two weeks further time has been prayed for filing counter affidavit. It has been stated by Sri B. P. Singh, learned counsel for the respondent, that strike of the State Government employees has come to an end and employees have joined yesterday and it is for this reason that prayer for further time has been made.
List this case on 11th December, 2013. On the said date Secretary, U.P. Education Board would remain present. However, the appearance of the Secretary Basic Education, Government of U.P. would be considered on the next date.
The interim order granted earlier to continue till the next date of listing.
