Petitioner is working as Assistant Teacher in Primary School Dhannuha District Kushinagar, whereas, husband of the petitioner is working in Primary School Uneha Islamabad Kishani District Mainpuri. It is urged that father-in-law who is aged about 75 years, is suffering from cancer.
Petitioner by the instant writ petition seeks the following relief :
Issue an appropriate writ, order or direction in the nature of mandamus commanding and directing the respondent No. 2 to consider and decide the claim of the petitioner regarding transfer of petitioner from District Kushinagar to District Mainpuri.
Learned counsel for the petitioner placed reliance on a decision rendered in Bibha Singh Kushawaha vs. U.P. Basic Education, Board, Allahabad and others, (Writ - A No. 30808 of 2017), decided on 19.7.2017.
Learned counsel appearing for the second respondent would submit that the second respondent-Basic Siksha Adhikari Kushinagar, District Kushinagar, shall pass appropriate order expeditiously.
In regard thereto, writ petition, on consent, stands disposed of directing the second respondent-Basic Siksha Adhikari Kushinagar, District Kushinagar, to consider and decide the claim/representation of the petitioner by a reasoned and speaking order in accordance with law expeditiously, preferably within a period of eight weeks from the date of filing of certified copy of this order.
It is made clear that the Court has not considered the claim and contention of the petitioner on merits.

Learned counsel for the petitioner has placed reliance upon a decision of this Court rendered in Writ-A No. 30808 of 2017 (Bibha Singh Kushwaha vs. U.P. Basic Education, Board, Allahabad and others).
Learned counsels appearing for the respondent would submit that the third respondent shall consider the representation of the petitioner.
In regard thereto, without entering into the merit of the case, as well as, rival contentions raised by respective parties, it is provided that the third respondent, Secretary, Board of Basic Education, Uttar Pradesh, Allahabad shall consider and decide the representation of the petitioner, in accordance with law, by a reasoned and speaking order, preferably, within eight weeks from the date of filing of certified copy of this order.
With the aforementioned observations/direction, the writ petition is finally disposed of.
