Heard Sri Lalji Yadav learned counsel for the petitioner, learned Standing Counsel for the opposite party Nos.1 & 3 and Sri Sandeep Kumar Yadav, learned counsel for the opposite party Nos.2 and 4.
Learned counsel for petitioner submits that the petitioner is a male teacher working in Upper Primary School-Manjha, Block-Nighasan, District-Kheri since his appointment in September, 2015. Due to medical reasons the petitioner has made a request for inter district transfer from District-Kheri to District-Hathras to the Secretary, Basic Education Board, however, he is ready to make a fresh representation before the State Government which may be considered.
Learned Standing Counsel as well as learned counsel for opposite parties no. 2 and 4 submit that the request of the petitioner for inter district transfer can be considered by the State Government only.
Considering the submissions made by the parties' counsel, the writ petition is disposed of at this stage with liberty to petitioner to move appropriate representation before opposite party no.1, Secretary, Basic Education, Government of U.P., Lucknow within one week from today and in case any such representation is made, it is expected that the same would be considered and decided by the opposite party no.1 in accordance with law and appropriate orders would be passed, expeditiously, say within a period of three months from the date of receipt of certified copy of this order along with copy of representation.
